In the following referred to as BnB Packaging GmbH.

scope

For the business relationship between BnB Packaging GmbH and the customer, these general terms and conditions apply exclusively in the version valid at the time of the order. Differing conditions of the customer are not recognized.

conclusion of contract

The presentation of the products in the online shop does not represent a legally binding offer, but a non-binding online catalogue. After entering your personal data and by clicking on the "Conclude order" button in the final step of the ordering process, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after the order has been sent. The purchase contract is concluded with our order confirmation or delivery of the goods. If you do not receive an order confirmation or delivery from us within 2 weeks, you are no longer bound to your order.

In the case of orders with delivery to third parties, the purchaser is deemed to be the client. If the delivery is made to third parties for their benefit or if the recipient of the delivery is enriched in some other way by taking possession and further using the delivery, the purchaser and the recipient of the delivery are jointly deemed to be the client. By placing such an order, the customer tacitly assures that the consent and the authorization for this exist.
When ordering for the account of third parties, regardless of whether in their own name or in the name of a third party, the orderer and the invoice recipient are jointly considered to be the client. A later change in the invoice after invoicing has already taken place at the request of the customer to another invoice recipient means the tacit assumption of debt by this invoice recipient. By placing such an order, the customer tacitly assures that the invoice recipient has the consent and authority to do so.

Shipment

The recipient of the goods with registered office/residence in a third country (e.g. Switzerland) must expect additional import duties (import duty and taxes) of his respective country.
These additional import duties are always to be paid by the recipient of the goods. The amount of import duties depends on the value of the goods and varies from country to country. Please inquire if even with your competent authority about the corresponding amount of import duties. BnB Packaging GmbH as the sender pays freight and export customs clearance.

right of withdrawal

Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods or Has. In the case of a single order for several goods that are delivered separately, the cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods or Has.

To exercise your right of withdrawal, please inform us by email or send the goods back to us within 14 days. The deadline is also deemed to have been met if the goods are returned in good time.

Consequences of the revocation:
If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (except for the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods.

For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you.
You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Special hint:
The right of withdrawal does not exist

1. Contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

2. Orders from companies in self-employment.

Warranty and liability

If there is a defect in the purchased item, the customer can choose to request subsequent performance in the form of a remedy of the defect or the delivery of a new item free of defects.

If the supplementary performance fails or if the customer has unsuccessfully set a reasonable deadline for supplementary performance, the customer is entitled to choose between withdrawing from the contract or demanding a reduction in price.

The limitation period is two years from delivery of the goods.

BnB Packaging GmbH is liable in accordance with the statutory provisions if the customer asserts claims for damages based on intent or gross negligence. Insofar as BnB Packaging GmbH is not accused of intentional or grossly negligent breach of contract, liability for damages is limited to the damage that typically occurs. BnB Packaging GmbH is not liable for the breach of ancillary obligations in the event of slight negligence.

Liability for culpable injury to life, limb or health remains unaffected; this also applies to mandatory liability under the Product Liability Act and other mandatory statutory provisions.

If BnB Packaging GmbH is responsible for a delay in delivery that has occurred, liability in the event of intent or gross negligence is determined by the statutory provisions, otherwise damage caused by delay will not be compensated. Compensation for damage caused by delay is limited to the amount of the order.

retention of title

The delivered goods remain the property of BnB Packaging GmbH until full payment.

Severability Clause

Should a provision in these terms and conditions or a provision within the framework of other agreements be ineffective, this shall not affect the effectiveness of all other provisions and agreements. The provision that has become ineffective will be replaced by a legal requirement that comes as close as possible to the original intention.
